Spanish Property - Don't adopt the "Manana" attitude!

Over the last few years, increasing numbers of people have moved to, or purchased second properties in Spain.

The relaxed lifestyle and much nicer weather are obvious attractions. There are however problems that arise when a person dies who owns a Spanish property. This is because the laws of England and Spain are different . There are examples of married couples owning Spanish property together and, following her husband’s death, she has not inherited his “share” of their Spanish property. In addition, the Spanish authorities obviously have to be involved to ensure that property is properly passed on.

In addition, the legal requirements for dealing with estates which include Spanish property are different depending upon whether a person died with a will made in Spain, with a will in England (or other country) or if they died without a will.

In order to ensure that there are no difficulties or unexpected problems, it is important to obtain specialist advice from lawyers who are able to guide you through the necessary requirements either on the making of wills which need to take account of Spanish properties or in dealing with the administration of estates containing Spanish property.

Due to the difficulties involved, it can often be much more cost and time effective to seek advice at the earliest available opportunity to ensure matters are dealt with smoothly and to your satisfaction.
