Mary Butler

Mary is the Senior Partner at Bell & Buxton and heads the Contentious Wills & Probate department. She specialises in handling the most complex contentious probate cases and financial abuse of the elderly, often receiving work by referral from other solicitors and law firms who recognise the need for cases to be handled by a lawyer with Mary’s experience and abilities.

Mary was awarded the Yorkshire Lawyer Awards 2006 Private Client Award in recognition of her skills, expertise and success in these areas of Private Client work, and won the same award again in 2009. She has been a Court of Protection Deputy authorised to act as a Deputy for an incapacitated person where no other suitable person can be identified. 

She is a registered member of the Association of Contentious Trust and Probate Specialists (ACTAPS), the Society of Trust and Estate Practitioners (STEP), Solicitors for the Elderly (SFE), and Action on Elder Abuse.

Mary is frequently consulted in contentious probate matters by TV and Radio producers and has appeared on BBC Look North and ITV's Tonight programme.  She has most recently been seen on the Crime & Investigation Network's "Battle of Wills" series.

Mary's recent experience includes:

  • a cross-border dispute over a multi-million pound estate;
  • appointment of Mary Butler as substitute Personal Representative in a complex family dispute;
  • unravelling of a litigated estate involving a number of properties;
  • various multi-million pound Inheritance Act/Constructive Trust/Estoppel claims;
  • a professional negligence and rectification claim arising out of the defective drafting of a Will by a will writer;
  • a successfully contested application by a third party to remove Bell & Buxton clients as Executors, resulting in a costs order being made in favour of our clients;
  • various high value and complex financial abuse cases, including applications to set aside transfers and gifts on the grounds of invalidity or undue influence.
